You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password.

We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the registration we have with the Data Commissioner’s Office. We use your information only for the following purposes:

Your Personal Information may be disclosed to other businesses within RS Connect and to reputable third parties who will help process your order. RS Connect requires all such third parties to treat your personal information as fully confidential and to fully comply with all applicable UK Data Protection and consumer legislation from time to time in place. We will not release your Personal Information to any company outside of RS Connect for mailing or marketing purposes.

You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your Personal Information and /or User Information, we are entitled to do so.

When entering any of our contests or prize draws, you provide your name, email address and mailing address. If you win, we will send the prize to the address entered and notify you by email. When you enter a contest or prize draw, you are also included in our newsletter list to receive notice of promotions, specials and new additions to the Website. You may unsubscribe from this news list by following the unsubscribe instructions in any email received.

We may use Cookies to keep track of your current shopping session to personalise your experience and so that you may retrieve your shopping basket at any time – if you do not accept Cookies you will be unable to use this Website for shopping purposes, only for browsing and research.

Delivery photography

If one of our Customer Delivery Partners attempts to deliver an order to your address and finds there’s no one available to receive it, we reserve the right to take a photograph of the outside of the property to assure you we were in the right geographical location to fulfil your order and confirm we had located the correct address. We can assure you that this photograph won’t be published or circulated, or used for any other purpose other than verification and that it’s held securely in compliance with Data Protection legislation.

Purchase of products

Payment

We accept payment by all major credit and debit cards (Visa, Mastercard, Switch, Visa Debit, Solo & Delta).
When you place a credit card order online, all the information you input is encrypted and passed to our secure SSL server. We follow strict security procedures in the storage and disclosure of information as per the Data Protection Act.

Pricing

All prices quoted include VAT at 20%. We reserve the right to withdraw a sale.

Discounts and Package Offers

Discounts and package offers are available at the discretion of RS Connect and are subject to change. If you have purchased a product with a discount you will not be entitled to a full price refund. Package deals contain discounts on the contents of the package and you will not receive a full price refund if you return any part of the package. The refund will be based on the overall discount value. Some items are provided free of charge and do not qualify for a refund or have any value towards a refund this will be clearly stated on the invoice.

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Ex-Demo/ Open Box Items

If a non-stock item order is placed then a deposit will be required, this will not be Non-refundable if the customer decides they don’t want to proceed after the order is placed and can take up to 2 – 4 weeks for delivery depending on when ordered in the month and the time of year.

Special Order / Non-Stock Items

These items will be sold fully complete unless otherwise stated. In some cases, the box may be opened or the protective film may have been removed. These items come with a 6-month warranty unless otherwise stated.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

  1. You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.
  2. You will be asked to confirm that you have read and agreed to our terms and conditions, if you choose not to agree then the order will not be able to be placed.
  3. We will send you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from RS Connect
  4. We will send you an order confirmation email.
  5. Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

Non-acceptance of an order may be a result of one of the following:

  1. The product you ordered is unavailable from stock.
  2. Our inability to obtain authorisation for your payment.
  3. The identification of a pricing or product description error.
  4. You do not meet the eligibility to order criteria set out in the main Terms & Conditions.
  5. The contract will be concluded in English.

Consumer Contracts Regulations 2013

This legislation offers you the following cancellation rights when you buy online or by phone:

  • You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.
  • Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
  • If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.
  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.
  • You can cancel by email [email protected], or call 01675 624000 or write to Customer Service, RS Connect Unit 1-3 Roman Way, Coleshill, Birmingham, B46 1HG.
  • If you decide to cancel, you should return the goods to us at ‘your’ cost within 14 days if the goods are unwanted and are not faulty, such cancellation we will reimburse you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply.
  • We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.

We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Delivery

Orders placed before 12pm (Monday-Friday) for delivery to a UK address are under normal circumstances dispatched from our warehouse the same day, subject to stock availability via a courier, for a standard three day delivery to the UK mainland.

*Orders Placed on Friday won’t be delivered until the following week.

RS Connect cannot be held responsible for late delivery due to the courier.

No refund will be made for late delivery.

Orders placed after 12pm during the week or at weekends are processed and dispatched the following working day.
There are several delivery options available when placing an order online.

Description of products

Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered into the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.

 

Guarantees for consumer electronics products

If you suspect your product to be faulty within 28 calendar days of purchase please contact us by email to obtain a Return Authorisation number.

We always honour the manufacturer’s guarantee period where offered; these are usually one year unless otherwise stated. Please see individual product pages for details.

What does the guarantee cover?

Our guarantees provide full cover against mechanical breakdown through normal use. This means that if your item develops a fault during the guarantee period, we’ll arrange for it to be repaired or replaced free of charge, including all parts and labour. Your guarantee is not transferable with ownership.

How does it work?

During the guarantee period, if your product develops a fault that needs to be repaired, look for visible signs of the breakdown and consult the fault-finding guide in the manufacturer’s handbook.

If that doesn’t resolve the issue, please contact us. You’ll need to provide us with details of your item, including the model number and date of purchase. You’ll find all of this information on the original confirmation of the order – this acts as your guarantee, so please make sure you keep it safe.

If we can’t repair your item, we’ll replace it with an item of equivalent specification. If no equivalent product is available we‘ll discuss an alternative settlement with you, and we’ll always do our best to make sure that you’re satisfied with the outcome.

What’s not included?

There are some specific exclusions from our guarantees, as follows:

  1. Repair costs caused by external factors such as computer viruses, faulty software, fire, theft, and weather (including lightning damage)
  2. Accidental damage, for example, if your item has been dropped. You may find that this type of damage is covered by your household contents insurance policy
  3. Pixel spots. These are tiny dark or bright spots that may become visible on a screen
  4. Consumables such as batteries, storage media, fuses, light bulbs etc.
  5. Data loss
  6. Cosmetic items such as trim, scratches, dents, corrosion or colour where the function of the product is unaffected
  7. Any loss suffered as a result of not being able to use the product or any loss over and above the purchase price of the original item
  8. Servicing, inspecting or cleaning of the product; and failure to follow the manufacturer’s instructions and/or installation guidelines
  9. Deliberate damage or neglect of the product
  10. Products that have been modified may not be covered under warranty
  11. Please note that our guarantees provide services for goods bought and used in the UK, the Isle of Man and the Channel Islands

 

Additional Costs with a Warranty Claim

  1. Items that have been returned that are not considered faulty will be returned at the cost of the customer without exception. The customer will be informed before shipping.
  2. If the device isn’t working correctly because it requires a firmware upgrade or SD card format the customer may/will be responsible for all postage costs to return the item.
  3. If you choose not to have the device repaired there may be an inspection fee of £25 charged

Returning of Faulty items

No faulty items should be returned without first contacting us. Upon contacting us, a returns number will be issued to you which will enable us to process the returned item.

If a unit is returned to us with no returns number, we will be unable to process the return.

We suggest that you use a secure delivery method, preferably one which is insured and requires a signature upon delivery.

No responsibility can be made for items lost or stolen whilst in transit to us. Where possible returns are usually processed within 72 hours of receipt.

Important notes;

  1. Items that have been modified will not be covered under warranty
  2. Damaged items are not covered under warranty and will be charged for if replaced, you will be informed before any work is carried out.

Refund Policy

Return of Non-Faulty Goods

In the unlikely event of you changing your mind about your purchase, we offer a 14 day money-back guarantee on all of our products. Simply contact us to obtain a return authorisation number.

The following conditions apply:

  1. No items should be returned without first contacting us. Upon contacting us, a returns number will be issued to you which will enable us to process the returned item. If a unit is returned to us with no returns number, we will be unable to process the return.   2. Items must be returned in the original undamaged packaging
  3. We cannot and will not refund the cost of any labour & material costs of an installation or removal of the goods under any circumstances.

Installation

  1. All installations will be carried out by RS Fleet Installations Ltd who are RS Connect preferred supplier.
  2. RS Fleet Installation will install the customer product at the location of the customers choice, most frequently the home address as recorded in the registration on the e-commerce site
  3. The products purchased by the customer shall be delivered directly to the customer from the RS Connect Warehouse.
  4. The RS Connect team will in a timely manner then contact the customer direct to arrange a convenient time and date for the installation of the said product.
  5. Installation is included in the cost of the product unless otherwise stated.
  6. Deinstall for any reason, is chargeable at the current rate. The current rate can be ascertained by calling RS Connect Sales team on call 01675 624000.
  7. It may under certain circumstances invalidate the warranty of the product if anyone except a certified installation expert installs the product.
  8. If an agreed and booked installation is changed or cancelled a charge will be levied. For more information around charges and cancellation parameters please refer to our Installation Policy here [insert hyperlink].

Consumer Contracts Regulations 2013

  7. We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied. (Returned goods that have been opened, used or registered or the packaging is damaged can result in a charge of up to £50 however this is at the discretion of our Customer Services team). Missing items will be charged for, you are responsible to take reasonable care of the product prior to return.
  8. If the software has been opened then we can not refund these items unless they are faulty and these will only be replaced.

General

Intellectual property and the right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

  1. any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
  2. any loss of goodwill or reputation; or
  3. any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what TTW and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Law

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
